Acceptance

Please read these terms carefully – they concern the use of this website. By proceeding with access to our website, you are deemed to have accepted these terms. This website, and the information contained on it, is not directed at, or intended for distribution to or use by, any person or entity who is a citizen, resident of, or located in, any jurisdiction where such distribution, publication, availability or use would be contrary to applicable law or regulation or which would subject Everyday Legal to any registration or licensing requirement within such jurisdiction.

This website, the information contained in it or derived from it, belongs to Everyday Legal and is for its customer use only and only use which is not contrary to any applicable law or regulation. You will not (directly or indirectly) perform, authorise, encourage or assist others to perform “mystery shopping” of this website, which is, the accessing of this website or its contents, for the purpose of obtaining any information or pricing other than a genuine reason for your own use.

You must not request, receive, make use of or pass on any information or data derived from or accessible via this website for any commercial purpose other than the one you have subscribed to or paid for. You must not resell or otherwise make any gain, financially or commercially from the templates or any other part of the service provided through this website. We do not accept liability for any inaccuracies, errors or omissions.

Legal Content

Everyday Legal makes available legal templates for self-populating with content provided by its customers. It is not a law firm and does not provide advice whether legal or otherwise. The templates provided are not to be construed as legal advice. Whilst endeavours are made to provide that the legal templates are accurate, correct and up to date, there can be no guarantee of this, nor that the service is appropriate for each and every customer.

The templates we provide are good model starting points for your basic needs. They are what they are, namely templates and you are encouraged to adapt these to your needs. They are available for download in Word or other editable formats for further editing by customers in order to reach a more precise retail requirement. We do not give legal advice so if you do need advice, please instruct an appropriately qualified law firm. We are not holding out as lawyers nor are suggesting that the need to receive legal advice is reduced by the provision of our service.

As Everyday Legal is not a law firm there is no solicitor client relationship and we do not and will not represent you. We are not regulated by the SRA and your communications with us are not protected by solicitor client privilege.

Accuracy of Information

Everyday Legal tries to ensure that all information provided as part of this website is correct at the time of inclusion on the website but makes no representation or warranty as to the completeness, accuracy, currency, adequacy or suitability. The information included in this website has been compiled from a variety of sources and is subject to change without notice.

No Offer

The information on this website is provided purely for information and does not constitute or form part of any offer or invitation to sell or issue, or any solicitation of any offer to purchase or subscribe for, any securities in Everyday Legal or any other company, nor shall it (or any part of it) or the fact of its distribution, form the basis of, or be relied on in connection with or act as any inducement to enter into, any contract or commitment whatsoever with respect to any such purchase or subscription.

Payments and Memberships

The payment scheme at present is both membership and ‘pay as you go’ at the advertised price. Our monthly plans may be varied or amended as we see fit. If we do deem it necessary to amend a scheme, we will endeavour to provide reasonable notice to customers. Upon satisfactory completion of appropriate full payment, the item purchased will be available for upload and/or download in a selection of formats. We may from time to time introduce offers for such periods and categories as we choose. Such offers may take the form of discounts, coupons, or vouchers, to be introduced and withdrawn at our discretion.

Paid membership can only be accessed by providing a valid payment card. You accordingly authorise Everyday Legal collect payments from your payment card in respect of the appropriate recurring monthly membership fee. Customers who wish to purchase Tailor Made or other services must separately purchase those services. Customers may upgrade or otherwise change their membership categories either through the website or by e-mailing customer.services@everyday-legal.co.uk

We do not store payment card details. Our payment provider www.stripe.com manages subscription payments. In the event of unsuccessful payments by customers, Stripe may employ the use of previously submitted successful payment methods in order to preserve the continuance of existing membership schemes.

Membership Categories

Standard – free upon registration.

Personal – £9.99 per month – open to retail individuals. Account holder can pdf download up to 5 templates each month. Minimum membership period 1 month. Personal Membership does not cover the costs of Tailor Made or other services provide by Everyday Legal.

Professional - £9.99 per month – open to businesses. Account holder can download up to 5 templates each month. Brand portal available. Portals can be shared within a business. All download extras save for Word included. 10% discount on tailor made service. Minimum membership period 3 months.

Professional Plus - £19.99 per month – open to businesses. Account holder can download up to 10 templates each month. Brand portal available. Portals can be shared within a business. All download extras included. 20% discount on tailor made service. Minimum membership period 3 months.

Professional Accounts have a portal facility where sharing of templates with portal colleagues is optional by the account holder.

When a membership period renews automatically from one period to the next, any unused templates will not be carried forward to the next period.

It is not possible to have more than one simultaneous membership of each membership category. Where appropriate, memberships can be upgraded.

Cancellation of Your Membership

If for any reason you decide that you do not want to continue with your paid membership, you can cancel it via the website or by contacting us directly at customer.services@everyday-legal.co.uk. You can initiate cancellation during the applicable cool-off period (personal members only) or immediately after the minimum term has expired. If you do decide to contact customer services to cancel, you must provide at least 3 clear days notice (“Minimum Notice”) to us prior to the end of the active subscription period. Failure to provide the Minimum Notice may result in a further month’s fees being due and collected from your payment card.

Personal members may exercise their rights to cancellation during the 14-day statutory cooling off period which commences on the first day of membership. No refunds will be given if a customer has purchased and/or downloaded any template during the cooling off period. Downloading a document constitutes acknowledgement that any right to a refund under this clause is forfeited.

If you do not cancel within the 14-day cooling off period, you can only cancel in accordance with the first paragraph of this section. Cancellation of a paid for membership will result in the account holder being downgraded to Standard Membership.

Cancellation of a Professional Membership category will result in the sharing facility with portal colleagues removed.

Offers and Vouchers

We may from time to time introduce offers for such periods and categories as we choose. We may issue and/or offer vouchers through our website or through third parties. In the event that vouchers are promoted, one voucher will be issued for each separate purchase. The voucher value can be set against the purchase price of a further singular product purchase and no ‘change’ will be credited to the customer if the value of the voucher exceeds the price of the purchase. Vouchers may only be redeemed once, have no monetary value and cannot be exchanged for cash or for any other form of credit to a customer. The issuing of vouchers is ex gratia and does not form part of the contract between a customer and Everyday Legal Limited. Vouchers will not be valid after their expiry date and will not be accepted. Vouchers may not be exchanged, sold or otherwise transferred to a third party. We will not be liable for any loss of vouchers or customers inability to download or store these. We will not accept vouchers which in our opinion have been edited, falsified, damaged or otherwise amended.

Refunds

We will not be responsible for any inability of a customer to effectively upload and/or download or store any document in that customer’s own hardware, unless such inability is due to the fault of Everyday Legal. We will only refund if we have fundamentally failed to provide the service to a customer. Customers always have the opportunity to view documents prior to payment and accordingly the act of payment by a customer is deemed satisfaction of both the template and the input of data by a customer. Any request for a refund has to be within 14 days from the date of payment. To ask for a refund please email us at customer.services@everyday-legal.co.uk . We are advised by our payment processor that refunds take between 5-10 working days to be processed.

Non-payment

Any failure to make full payment at any time may result in us terminating the service to you and demanding full payment. The service to you may be withheld until any payments are made in respect of arrears and we are satisfied that a restored payment is in place.

We may provide addresses or hyperlinks which lead you out of this website. Such addresses or hyperlinks are provided solely for your convenience and information. Your access to such websites or your use of such links to any other websites or pages is at your own risk.

Availability

Whilst we take all reasonable steps to ensure this website is always accessible, we will not be held liable if, for any reason, the website is unavailable for any period. We may also have to suspend access to the website for routine or emergency updates and maintenance, but we will endeavour to keep any disruption to a minimum. We reserve the right however, for any reason, to terminate, limit, suspend, or change the website (and service) at any time whether in part or as a whole, or your access to it. You agree that Everyday Legal will have no liability whatsoever for doing so.

In addition, we cannot warrant that this website will be free of viruses or defects of any description and we will not be held responsible for any technical problems you may suffer as a result of your use of this website.

The contents of this website are freely downloadable for browsing purposes only and may not be reproduced in whole or in part or otherwise made available without our prior written consent. This website was created in England. Any interpretation of its content, claims or disputes (of whatever nature and not limited to contractual issues) shall be subject to the exclusive jurisdiction of the English Courts under English law.

Variations

We absolutely reserve the right to update these terms at our own volition and at any time without notice to you. We do not have to justify any changes or variations but recommend you regularly revisit this page to ensure you have seen and are aware of our latest terms.

Our Rights

You acknowledge and agree that Everyday Legal reserves the rights to take such action as it considers appropriate to enforce these terms and conditions and/or abuse of the service provided. We may therefore be obliged to co operate with any regulator or authority and have the right to remove any material or content which we consider to be inappropriate, offensive or unlawful, and block or restrict any account on a temporary or permanent basis.

We work with our partners to provide suitable products and/or services for our customers, and in all cases your purchase contract is with the appropriate third party rather than us, where the product and/or service is provided by them.
